Terms of Use
Use of this website signifies your agreement to the terms and conditions as outlined below.
Travel Services Purchase Agreement.
For good and valuable consideration (including, without limitation, the mutual covenants and agreements of this Travel Service Purchase Agreement), the user (“customer”) agrees, without modification, to the terms and conditions of the air carrier, hotel, car rental company, tour operator or other supplier of travel services (“the travel service provider”) which are applicable to the travel services being purchased by the customer from the travel service provider. The customer acknowledges having had the opportunity to review the terms and conditions of the travel service provide prior to completing the purchase of the travel services.
Responsibility
In this Agreement, “CWT Harvey’s Travel” means the “Agency of Choice” selected by the customer. The Agency of Choice may be owned and operated by Harvey’s Travel Limited, a joint venture partnership with CWT. The customer’s rights, remedies and recourse under this Agreement for any breach of this Agreement by CWT Harvey’s Travel is solely and exclusively against the Agency of Choice, and the entities described above are not jointly liable for the obligations of CWT Harvey’s Travel under this Agreement.
In providing travel information, making reservations and issuing tickets and other documents to the customer, CWT Harvey’s Travel acts solely as the agent for the travel service provider. CWT Harvey’s Travel does not guarantee or insure the travel services to be provided by any travel service provider. CWT Harvey’s Travel assumes no responsibility for actions beyond its control in connection with travel services. CWT Harvey’s Travel is not responsible or liability for any claims, losses, damages, costs or expenses arising out of personal injury or death, loss of enjoyment, upset, disappointment, distress or frustration, lost of or damage to property, accident, delay, non performance, irregularity, or any consequence from them, which may be occasioned through the neglect or default or any act or omission of any travel services provider or any governmental authority or which may be occasioned through weather, equipment failure, labor disputes, sickness, theft or any other reason not within the direct control of CWT Harvey’s Travel. Without limiting the generality of the foregoing, CWT Harvey’s Travel is not responsible for any consequential damages whatsoever.
CWT Harvey’s Travel transmits the proceeds from the sale of travel services to the travel service provider supplying those travel services and CWT Harvey’s Travel acts as the travel service provider’s agent. In the event that such a travel service provider defaults prior to providing the travel service for which payment has been made, the customer’s sole recourse for refund shall be with the defaulting travel service provider, or from insurance covering such defaults.
CWT Harvey’s Travel disclaims all liability for errors or bias in reservations, fares, or other information provided by any automated airline reservation system.
Eligibility
The customer must be at least 18 years of age in order to purchase travel services under this Agreement and must be a resident of Canada.
Email Marketing
When the customer in the ac of purchasing travel services, provides their email address, they have indicated implied consent to be communicated to via electronic communication (email). This is also considered expressed consent. CWT Harvey’s Travel provides the customer the option to unsubscribe, which will be prominently displayed in all marketing communications.
Pricing and Content
All prices listed in this website are in Canadian dollars unless otherwise stated. Airport fees for airports that require payment on site, where applicable, are not included in the pricing. All prices are subject to change without prior notice. CWT Harvey’s Travel is not liable for any fluctuation in price or change in schedule or equipment or accommodations in connection with any travel service that occurs before, during or after the purchase of the travel service. Should there be a discrepancy between the price shown on this website and that of the actual travel service provider, the latter shall prevail. All travel services are subject to availability and are deliverable to residents of Canada only. The processing fee on your travel reservation is quoted including GST, HST, or QST. The taxes charged are based on the province where your CWT Harvey’s Travel agency is located. In some cases, the amount of tax on the processing fee may change if your province of residence is different than where the agency is located. CWT Harvey’s Travel will apply the appropriate tax on your processing fee according to government regulations when the processing fee is charged. CWT Harvey’s Travel is not responsible for the content of external websites.
Booking Online
Please be advised that pricing is subject to availability at time of booking, may change without notice. During the online booking session, you should be aware that the product / pricing is subject to availability at time of booking, should your booking session time out, or you close the booking window, the price may be different the next time you log on. Pricing / product availability is valid if you purchase services in the same booking session.
Payment
Payment is required at the time of purchase for online bookings. Online purchases can be made using Visa, Mastercard or American Express credit cards. Third party credit card bookings are not permitted. All fraudulent purchases will be investigated and prosecuted. When allowed under the applicable travel service provider’s terms and conditions, CWT Harvey’s Travel may accept a deposit from the customer to reserve travel services. If full payment for the travel services is not received when due under the travel service provider’s terms and conditions, then the deposit shall be forfeited by the customer to the travel service provider. If the customer resides in the Province of Quebec, the customer authorizes CWT Harvey’s Travel to charge the Quebec travel compensation fund fee in accordance to OPC regulations (this fee is typically a nominal dollar abount per $1,000 of travel services purchased by the customer (excluding insurance, service fees, GST and QST) to the same credit card as the customer uses to purchase the travel services. The OPC charge will appear on the booking invoice /itinerary.
Confirmation and Delivery
After a purchase is made, the customer will receive an e-mail confirming the purchase. It is the customer’s responsibility to verify that the information contained in that email correctly reflects the travel services purchased. If the information in the email is incorrect, the customer must contact the Agency of Choice on the same day on which the online booking is made in order to have it corrected. Electronic tickets will be delivered by means of email transmission. For other travel documents issued by travel services providers, may be delivered by email, or delivery or pick up arrangements will be made with the customer by the Agency of Choice. If the customer elects to have any documents delivered by courier, applicable courier charges will be payable by the customer. The customer is responsible for compliance with the applicable tour operator’s document delivery conditions.
Documentation (Identification / Passport / Visa Information)
It is the responsibility of the customer to ensure that the customer and all other persons traveling with the customer have the appropriate documentation in their possession (such as current and valid passports, visas, and identification cards) before leaving Canada, and that they satisfy all other applicable requirements (such as vaccinations), to gain entry to the chosen destination and re-entry to Canada. The customer acknowledges having had the opportunity to review the applicable documentation and other requirements prior to completing the purchase of travel services. Obtaining passports and visas may require lengthy processing times and it is the customer’s responsibility to ensure timely receipt of all documents. The customer acknowledges that entry to another country may be refused even if the requirement information and travel documents are complete. Specialized notarized documentation may be required for unaccompanied minors and for children traveling without both parents.
CWT Harvey’s Travel requires legal names (first, middle names and last name) as they will appear on your passport at time of booking. A passport must be valid for 6 months beyond your return travel date is required for Canadian citizens. For up to date passport requirements please refer to the Government of Canada Travel and Tourism website (https://travel.gc.ca). If you are travelling as a non-Canadian passport, entry requirements may differ. Landed immigrants will require a Permanent Resident Card to return to Canada. Additional documentation may be required for non-Canadian residents. Travel immunizations should be up-to-date (ie. Covid-19, tetanus, diphteria, polio, typhoid, hepatitis, etc.). All passengers travelling or returning to Canada should refer to the latest government travel advisories for your travel destination. https://travel.gc.ca/travelling/advisories. Always recheck prior to every flight or consult with your travel advisor.
Airport Check-In
It is the customer’s obligation to check in at the airport for air travel within the time specified by the applicable travel service provider and following check-in, to proceed to the correct departure gate by the time specified on the customer’s boarding pass. A customer will be denied boarding if the customer has not checked in or arrived at the correct departure gate on time. CWT Harvey’s Travel is not responsible if the customer misses his or her flight.
Flight Times and Reconfirmation
All flight times, carriers, equipment and itineraries are subject to change with or without prior notice. If CWT Harvey’s Travel is made aware of a change by a travel service provider, it will use commercially reasonable efforts to advise the customer as soon as possible, during normal business hours. We can not be held responsible for schedule changes imposed by the airlines. All travelers are responsible for checking their flight times and status with the airlines at least 24 hours prior to departure, for both the before and return trips. In the event of a flight delay related to weather, traffic or an other force majeure situation, it may not be possible for the air carrier to provide meals and/or accommodations. This is subject to the terms and conditions of each applicable airline. CWT Harvey’s Travel is not responsible for lost wages, missed holiday time, accommodations, or any other additional charges incurred as a result of changes in times or itineraries.
Connecting Flight Times
Customers should allow for the minimum connecting time approved by the applicable travel service provider in order to reduce the risk of missing connecting flights. All connecting flight reservations are made at the risk of the customer and CWT Harvey’s Travel is not liable for damages or additional fees incurred by the customer owing to a missed flight connection, whatever the reason. Your flight connection may require an over night accommodations or next day arrival. Any stop over hotels will be an additional cost and not included in your package pricing.
Foreign Travel
Air travel to other countries is governed by various conventions and agreements between Canada and the other governments, which are incorporated into the terms and conditions of the customer’s purchase of applicable air travel services. Incorporated terms may include, but are not restricted to:
- Limits on liability for personal injury or death;
- Limits on liability for lost or damaged baggage and its contents; including fragile or perishable goods, and availability of excess valuation coverage;
- Claims restrictions, including time periods within which passengers must file a claim or bring an action against the air carrier;
- Rights of the air carrier to change the contract;
- Rules on re-confirmation of reservations, check-in times and refusal to carry; and
- Rights of the air carrier and limits on liability for delay or failure to perform service, including schedule changes, substitution of alternate air carriers or aircraft and rerouting
It also is the customer’s responsibility to become familiar with the relevant laws and customs of the countries of destination. The customer acknowledges that the living standards and practices at the destination and the standards and conditions there with respect to the provision of utilities, services and accommodation may differ from those found in Canada.
Baggage Allowance
The customer must consult the terms and conditions of the applicable airline for restrictions on the number and weight of baggage on chartered and schedule service. Lost or damaged baggage is the responsibility of the airline, which may have limited liability. CWT Harvey’s Travel recommends the purchase of insurance for loss of, or damage to, baggage. In the event of damaged, lost or delayed baggage, please contact the applicable airline representative prior to leaving the airport. Failure to do so will invalidate the customer’s claim. Note: additional baggage fees may apply based on the airline you have selected. Please check with your applicable airline website for baggage information.
Supplier Terms
Whether travel is purchased directly with a travel advisor or online using our booking tool, all travelers should review the terms and conditions of the travel provider at the time of booking. Please pay particular attention to the fare basis terms for flights, as well as any payment terms as many products are non-refundable, non-changeable or imposed fees for changes.
When booking flights online, hover over the fare bases information menus to review all the applicable terms and conditions prior to booking.
Insurance
CWT Harvey’s Travel offers the customer the option of purchasing travel insurance, including trip cancellation insurance and out of province health insurance, to insure the customer against the risks described in the applicable policy that may occur prior to, during or after the customer’s trip. It is recommended that the customer purchase travel insurance.
There are different types of insurance packages available. Travel insurance may only be purchased by the customer within 48-72 hours of purchasing the travel services to which the insurance relates or prior to the day of departure, whichever is earlier (excluding out of province medical only insurance, which may be purchased anytime up until departure). The customer also may change the type of insurance coverage purchased only within the same period. Cancellation of an insurance package purchased through CWT Harvey’s Travel must be submitted within 10 days of purchase or prior to the day of departure, whichever is earlier. To make an insurance claim, it is the customer’s responsibility to contact the insurance carrier as soon as possible. Please contact your Travel Advisor at CWT Harvey’s Travel for complete information regarding travel insurance requirements.
The customer acknowledges that it has been made aware of the availability of travel insurance coverage, including trip cancellation insurance and out of province health insurance, and the customer has either purchased or expressly declined to purchase that insurance prior to completing the purchase of travel services.
Cancellation and Changes
Cancellation penalties for purchased travel services vary depending on the travel service provider. In many cases, the price of travel services is 100% non-refundable or cancellation carries stiff penalties. travel service arrangements also may not be changeable, or they may be changeable only upon payment of a fee that is determined by the travel service provider. The customer should consult the terms and conditions of the applicable travel service provider before completing the purchase of travel services.
Jurisdiction and Class Actions
This Agreement shall be governed by and construed in accordance with the laws of the province in which the Agency of Choice is located and the laws of Canada applicable in it and shall in all respects be treated as a contract of that province. The customer expressly waives his or her right to participate in a class action suit against CWT Harvey’s Travel for any cause of action arising out of this Agreement.
Privacy
CWT Harvey’s Travel is committed to protecting the privacy of customer’s personal information, including financial information. CWT’s Privacy Policy may be viewed here. By purchasing travel services, the customer agrees that the Agency of Choice may contact the customer in connection with the purchase of those travel services.
Miscellaneous
The customer acknowledges and agrees that the customer shall execute this Agreement by:
- Clicking on the appropriate icon indicating that the customer agrees with the terms and conditions of this Agreement; providing his or her name on the website page where the details of the travel services requested are supplied and
- Providing the customer’s credit card type, number and expiry date
The parties declare that they have requested that this Agreement and any amendments or modifications to it be drafted in English. Subject to the other terms of this Agreement, this Agreement includes the travel service specifications, prices, travelers and all other travel arrangements indicated on the page of this website where these details have been supplied. If you have any questions or concerns regarding this Agreement, please contact the Agency of Choice. In addition to these Terms, other terms and conditions established by Travel Supplier (such as an airline’s terms and conditions of carriage, accommodation terms and conditions or a car rental company’s rental agreement) apply to your booking (“Rules and Restrictions”). To make a reservation, you must agree to the Rules and Restrictions of the Travel Provider you select (such as those relating to the payment of amounts due, refunds, penalties, availability restrictions and use of fares or services). The relevant Rules and Restrictions are provided to you before you make a booking and are incorporated by reference into these terms. If you breach a Travel Provider’s Rules and Restrictions, your booking may be cancelled and you may be denied access to the relevant travel service. You may also forfeit any monies paid for that booking and we or the travel supplier may charge your account for any costs occasioned by such breach.
